General Terms and Conditions of Sale (GTC)

Parfumerie Amicale, a simplified joint stock company with share capital of €84,980, whose registered office is located at 27/29 rue Guénégaud, 75006 Paris, registered with the Paris Trade and Companies Register under number 794 741 157 (hereinafter “OFFICINE UNIVERSELLE BULY”) markets, through its website www.buly1803 (the “Website”), perfumery and cosmetic products designed in accordance with the high standards of French perfumery tradition (the “Products”).

These General Terms and Conditions of Sale (hereinafter the “GTC”) are intended to define the terms and conditions governing the online sale of Products by the Officine Universelle Buly to its Customers, as well as the rights and obligations of the Parties arising from the online sale of Products offered on the Website. These GTC apply to all orders for Products placed by final consumers via the Website, with the exception of “special orders” or “bespoke” Products or “Exceptional Perfumes”.


These GTC apply to all orders shipped within France and internationally. To check whether your address is eligible for shipping and to find out about the available shipping options, please enter your postcode in the “Shipping” section during the ordering process.


The General Terms and Conditions of Sale are made available to the Customer on the Website at the following address: https://www.buly1803.com. It is specified that the Customer may, at any time, save or print these GTC by clicking on the “Print/PDF” link, provided that they are not modified, and that a copy thereof will be sent to the Customer with the order confirmation email.

The Officine Universelle Buly reserves the right to update the GTC at any time. In the event of an amendment to the GTC, the version in force on the date of the order shall be the version attached to the order confirmation email.


Sales made through the Website are reserved for consumers (the “Customers”).


Given the prestigious nature of the Products, their sale is carried out through a selective distribution network. Consequently, the Products may under no circumstances be distributed or resold.

I. Availability


The Products offered for sale by the Officine Universelle Buly are those presented on the Website on the day the Customer visits the Website, subject to availability and in accordance with the terms and conditions of sale, including pricing, as specified on the Website.


The Officine Universelle Buly reserves the right to modify, at any time and without prior notice, the Products offered for sale on the Website as well as the terms and conditions of sale of the Products.
The Officine Universelle Buly takes the greatest care in the presentation and description of the Products.

 However, if any substantial errors or omissions appear on the Website, the Officine Universelle Buly shall not be held liable for this. It is understood that the photographs illustrating the Products are for information purposes only and are not contractually binding.


The Officine Universelle Buly does not guarantee the availability of the Products presented on the Website. In the event that one or more Product(s) are unavailable after an order has been placed, the Officine Universelle Buly will notify the Customer by email or by telephone as soon as possible of the unavailability of the Product(s) and the possible cancellation of the order.


In the event of a total cancellation of the order due to unavailability, the Customer’s order will be automatically cancelled and their bank account will not be debited. If the bank account has already been debited, the Officine Universelle Buly will refund the Customer within 14 days of the payment date at the latest.


Should a partial cancellation of the order occur due to unavailability:

  • The Customer’s order will be confirmed and their bank account will only be debited for the amount corresponding to the Products actually shipped;
  • The Customer will be notified as soon as possible, by telephone or email, of the unavailability of the Products concerned;
  • The Customer will receive delivery of the available Products.

The Officine Universelle Buly shall not be held liable in the event of stock shortages or unavailability of Products.


Any order may include free samples selected by the Customer, provided that the Customer expressly requests such samples, up to a limit of two samples per order and subject to availability. If the samples requested at the time of ordering are unavailable, they will not be replaced in the order, and this will be  without prior notification to the Customer.


II. Price


The terms of sale of the Products, particularly the pricing conditions, are those in force at the time the order is accepted.


Product prices are fixed. They are listed in euros, all taxes included. The Officine Universelle Buly reserves the right, which the Customer accepts, to modify the prices of the Products offered on the Website at any time and without prior notice, without any further formality other than posting such changes on the Website. However, these changes will not affect orders placed and confirmed by the Customer prior to the entry into force of those changes, subject to the availability of the Products ordered at that time.


The prices of the Products displayed on the Website do not include shipping costs. The method and amount of shipping costs are specified during the ordering process, before the Customer confirms the order. The various shipping methods are also set out below in the present General Terms and Conditions of Sale and may be modified at any time by the Officine Universelle Buly. Nevertheless, these amendments shall not affect orders validated by the Customer prior to the entry into force of the modifications.


Shipping costs are payable by the Customer or by Officine Universelle Buly depending on the country/region of delivery and the option selected by the Customer, in accordance with the following terms and conditions:

  • Local delivery - by courier: price varies depending on the order – available only for the city of Paris.
  • Shipping by DHL Express in mainland France, the European Union (excluding France), San Marino and Monaco, and outside Europe: depending on the country/region, an additional charge will be requested from the Customer based on the country/region of delivery and the DHL rates in force on the day of the order.

The price charged to the Customer is the price indicated on the Website when the order confirmation is sent by email by the Officine Universelle Buly.
The Customer acknowledges that, depending on the country/region of delivery chosen at the time of ordering, they may be required to pay customs and/or import duties in accordance with the legislation in force in that country/region. Such charges shall be added to the price of the Products indicated on the Website. 


Furthermore, it is specified that for customers residing outside the EU and having their orders delivered in France, no tax refund service will be offered through the Website.

To benefit from this service, the Customer is invited to visit Officine Universelle Buly Boutique located in France, the list of which can be found on the Website.


III. Retention of Title


The Products ordered remain the property of the Officine Universelle Buly until full payment has been received by the Officine Universelle Buly, including the principal value of the Products and any applicable fees and taxes appearing on the invoice.


IV. Ordering Process


1.    Customer Order Placement on the Website

1.1    Browsing the Website


By browsing the Website, the Customer has the opportunity to view the various Products offered for sale on the day of their visit on the Website.
Browsing the various pages of the Website does not oblige the Customer to place an order.


1.2 Ordering Process on the Website 


While browsing the Website, a Customer wishing to place an order may do so by following the procedure established by the Officine Universelle Buly:


To place an order on the Website, the Customer must be at least 16 years old, have legal capacity and hold a Credit Card (Carte Bleue, Visa, Master Card, American Express, JCB, Diners Club or Discover exclusively) and/or a PayPal, Google Pay and Apple Pay account.

It is specified that the Products are intended for the Customer’s personal use only, with no direct connection to their professional activity.
In the event of an order appearing abnormal, the order may be considered null and void and will not be processed by the Officine Universelle Buly. An order is considered abnormal when the Customer purchases more than six (6) Products with the same reference number.


In order to confirm their order, the Customer must follow the sequence of the following steps:

Step 1: Identification and selection of the Product


The Customer must select one or more Product(s) offered on the Website. On the Product page, the Customer is offered the option of choosing a paid engraving service that allows them to personalise the Product with an inscription of their choice. The engraved text is the sole responsibility of the Customer and must not, under any circumstances, infringe the rights of third parties, in particular intellectual property rights, nor be defamatory, abusive, unlawful or discriminatory. Should this be the case, the Officine Universelle Buly reserves the right to refuse to engrave the message and to cancel the corresponding order.


The Customer then clicks on the “Add to basket ” button, which appears next to each Product viewed, and indicates the desired quantities.


By clicking on “View cart”, the Customer can review the items added to their cart and remove or add items at any time.


On the shopping cart page, before finalising the order, the Customer has the option to select (or decline) one complimentary sample (2ml format) from those offered by the Officine Universelle Buly in the drop-down list (within the limits of available stock). If the samples requested when placing the order are unavailable, they will not be replaced in the order, and this will be without prior notification to the Customer.

The Customer then has the option of adding a gift message to their order.


By confirming their cart (by clicking on the “proceed to checkout” button), the Customer initiates the ordering process. It is the Customer’s responsibility to check the virtual cart and, if necessary, modify its contents and/or the quantities desired for each Product.


If they have not already done so, the Customer must then log in to the Website using their email address and password or create an account if this is their first order. The Customer may also choose to proceed without creating an account. These procedures require the Customer to provide their full contact details (title, surname, first name, billing address, email address, telephone number and date of birth), as well as the shipping address. The Customer undertakes to provide accurate and complete identification information.


The Customer is then invited to select their contact preferences (email, post, telephone, text message), to tick the box “I wish to subscribe to the bi-monthly newsletter of the Officine” if they wish, and to specify whether the billing address is different from the shipping address by ticking the box “Use shipping address as billing address”.


The Customer is then invited to click on the box “Confirm”.


The Customer is then redirected to the “Shipping” step.


Step 2: “Shipping”


The Customer is invited to edit their shipping address to make any necessary changes.


Shipping is made according to the following arrangements:

  • Local delivery - by courier: price varies depending on the order – only available in the city of Paris.
  • For mainland France: DHL (express), for which an additional charge will be requested from the Customer depending on the country/region of delivery and the DHL rates in force on the day of the order.
  • For the European Union (excluding France), San Marino and Monaco: depending on the country/region concerned: DHL (express), for which an additional charge will be requested from the Customer depending on the country/region of delivery and the DHL rates in force on the day of the order.

However, the Customer acknowledges that, depending on the country/region selected when ordering, they may be requested to pay customs and/or import duties in accordance with the legislation in force in that country/region.

The Customer is then invited to click on the “Review Order” button. 

 

Step 3: “Review Order”


A summary of the order will be displayed, specifying in particular the essential characteristics of the Products, the quantity and price of the Products, the shipping costs, and the total amount of the order (including shipping costs).

The Customer is invited to check their order and their shipping and billing address, and, if necessary, correct any errors or make changes.


The Customer is then asked to enter any discount code and choose the payment method, which is only possible by Credit Card (Carte Bleue, Visa, Master Card, American Express, JCB, Diners Club or Discover exclusively) or PayPal, Google Pay and Apple Pay. Payment by cheque or cash is not accepted.


(i) Payment by Credit Card 


The Customer chooses the type of Credit Card with which they wish to proceed to payment (Carte Bleue, Visa, Master Card, American Express, JCB, Diners Club or Discover exclusively).


Credit Cards issued by banks outside France must necessarily be international cards. 


The Customer must enter their Credit Card number, its expiry date, the name of the cardholder and the security code corresponding to the last digits printed on the back of their Credit Card. 


The Credit Card is debited when the order is dispatched.


By making this payment, the Customer guarantees that they are fully authorised to use the Credit Card used for their order and that this card provides access to sufficient funds to cover all costs resulting from this order. In the event of refusal by the bank, the order will be automatically cancelled.


By providing their Credit Card details, the Customer agrees that the Officine Universelle Buly may proceed with the secure transaction. 


The Customer has the right to access, modify and delete their personal data at any time by writing to the Officine Universelle Buly, providing proof of identity, via the contact section available on the Website.


(ii) Payment by PayPal


When confirming the order, if the Customer chooses the “PayPal” payment option, they will be automatically redirected to the “PayPal” platform.


The Customer must then log in to their PayPal account using their login details. If they do not have a PayPal account, they can create one at this point. After confirming their order with PayPal, the Customer will be redirected to the payment confirmation page of https://buly1803.com.


The Customer must read these GTC, which will be available via a hyperlink, and tick the box “I have read and accept the General Terms and Conditions of sale”.

By ticking the box accepting the GTC when placing an order, the Customer expressly and unreservedly accepts the terms and conditions set out in these GTC.

Once the Customer has clicked on the “Proceed to Payment” button, the sales contract is considered to be definitively concluded. Once confirmed, the order is forwarded for processing. It can only be modified or cancelled under the conditions expressly provided for in these GTC or as required by applicable law.


The data recorded by the Website www.buly1803.com constitutes proof of all transactions carried out between the Officine Universelle Buly and its Customers. Should there be a dispute regarding a transaction carried out on the Website, the data recorded by the Officine Universelle Buly shall be considered irrefutable proof of the content of the transaction.


It should be noted that the order is only confirmed and dispatched once the payment made by the Customer has been confirmed.


In the event that, for any reason whatsoever (exceeding the order limit, opposition, refusal by the issuing centre to authorise payment, etc.), it proves impossible to debit the amounts owed by the Customer, the order will not be registered by the Officine Universelle Buly, which will immediately inform the Customer by email. In this regard, and in order to prevent fraud and ensure that the Customer is the holder of the payment method used, the Officine Universelle Buly reserves the right to ask the Customer for a copy of their identity card and Credit Card for any order exceeding 500€ including VAT (excluding shipping costs).

In all circumstances, the Officine Universelle Buly, reserves the right to refuse any order from a Customer with whom there is dispute or an incident relating to the payment of a previous order, or who would be in breach of the provisions hereof. In such a case, the Officine Universelle Buly will inform the Customer by email. Should the Customer fail to regularise their situation with the Officine Universelle Buly, the Officine Universelle Buly reserves the right not to process the order.


The Officine Universelle Buly reserves the right to refuse any order from a Customer where it is apparent that the Customer intends to resell the Products for commercial purposes. In this respect, any order appearing to be abnormal may be deemed null and void and will not be taken into consideration by the Officine Universelle Buly. An order is considered abnormal when the Customer purchases more than six (6) Products of the same reference in a single order or repeatedly over a short period of time.


The Officine Universelle Buly reserves the right to refuse any order from a Customer in case the Product concerned is out of stock, if a request for personalisation does not comply with the provisions of these GTC, or for any other legitimate reason. 


It is specified that in the event of inappropriate behaviour by the Customer towards the staff of the Officine Universelle Buly or towards members of the Customer Service team (violent, defamatory, obscene, offensive, indecent, tactless remarks, etc.), the Officine Universelle Buly reserves the right to change the Customer’s contact person, report the Customer to the Customer Service, and to cease responding to the Customer by blocking their number and/or excluding them from its customer database.


1.3 Confirmation of the order by the Officine Universelle Buly


Following the confirmation of payment by the Customer, an email summarising the order is then sent to the Customer by the Officine Universelle Buly once the order has been processed.


For this purpose, the Customer expressly agrees to the use of email by the Officine Universelle Buly to confirm the content of their order. This email, which constitutes an acknowledgement of receipt of the order, sets out all the essential terms of the order, namely:
-    The reference of the order;
-    The date and time of the order;
-    The payment method;
-    The iIdentity and contact details of the Customer;
-    The nature, quantity and price of the Products purchased;
-    The samples selected;
-    The shipping costs and arrangements;
-    The total amount of the order (including shipping costs);
-    The information related to the identity and contact details of the Officine Universelle Buly;
-    The rights and guarantees of the Customer as referred to in Article V of the GTC, and the conditions, time limits and procedures for exercising the right of withdrawal as referred to in Article VI of the GTC; 
-    The invoice, serving as proof of payment confirmation. In any circumstance, invoices are provided upon delivery. 

The order confirmation email mentions the right of withdrawal and includes the Terms and Conditions of Sale in PDF format.

Validation of the payment by the Customer and the email confirming acceptance of the order by the Officine Universelle Buly shall constitute proof of acceptance of the said order and of its final confirmation. These elements shall render the amounts incurred payable in respect of the Products listed in the order.

1.4 Dispatch of the order


It is reminded that orders will only be dispatched once the payment method has been verified and authorisation to debit the Customer’s Credit Card has been received.


If certain Products ordered are unavailable (see Availability), only the price and any applicable transport costs relating to the Products that are available and delivered will be debited.


The order will be processed within a maximum of thirty (30) days from the day following the date on which the Customer submitted their order, subject to full payment of the price.


Once the order has been prepared, it will be shipped to the postal address provided by the Customer as the delivery address when placing the order, it being specified that the address cannot be a PO box, a general delivery address, a non-permanent address or residence (i.e., including but not limited to mobile homes, caravans, campsites, and other non-permanent residences), a hotel or other accommodation facility, or a collective location where an individual address cannot be clearly and permanently assigned to a natural person.


An email is sent to the Customer to inform them of the dispatch of their order.

1.5 Receipt of the order 


Since the delivery is carried out by a third-party provider, the Customer is informed that the Officine Universelle Buly cannot in any way be held liable if the non-performance or improper performance of this obligation is attributable to the Customer, to an unforeseeable or insurmountable act of a third party to the contract, or to a case of force majeure.


Products purchased will be delivered in accordance with the methods set out in Articles II and IV.1 above, within the following average timeframes: 2 to 5 working days from dispatch for deliveries within France, and up to 3 weeks depending on the country or region.


Any delay in delivery must be reported as soon as possible via the contact section.  


Each delivery is deemed to have been completed as soon as the Product(s) are made available to the Customer by the carrier, as evidenced by the control system used by that carrier.


It is the Customer's responsibility to check immediately the conformity and integrity of the Product(s) shipped, as well as the condition of the packaging, upon receipt of the Product(s).
In the event of a damaged parcel: 

  • If the delivery person is present: the Customer must refuse the delivery and issue complete and precise remarks on the delivery note upon receipt. In any case, the Customer may only exercise their right of recourse against the carrier, to whom the remarks must be addressed. Any remarks must be confirmed by registered letter to the carrier within three (3) days following the refusal of delivery. The Customer must also notify the refusal of delivery to the following address: contact@buly1803.com.
  • If the delivery person is not present: the Customer must not open the parcel and must notify the refusal of delivery to the following address: contact@buly1803.com.


The Customer Service department of the Officine Universelle Buly will handle the return in collaboration with the delivery service provider.


In the case of delay, damage or missing items, the Customer must note their full and precise remarks on the delivery note upon receipt. In any case, the Customer may only seek recourse against the carrier, to whom the remarks must be addressed. All reservations must be confirmed by registered letter to the carrier within three (3) days of receipt. 


Any remarks regarding a damaged Product must also be notified in full and in detail (accompanied by any supporting documents, including proof of purchase and photographs showing the damaged Product) by the Customer to the Officine Universelle Buly within a maximum period of fourteen (14) days from receipt of the Product concerned, by contacting the customer service at contact@buly1803.com . In this case, the Customer must keep the damaged Products for the entire duration of the complaint process.


Any reservation concerning an order or a missing Product that has not been delivered after the specified delivery date, for any reason other than force majeure, must be notified in full and accurately by the Customer to the Officine Universelle Buly by sending a message to the customer service at contact@buly1803.com. If the Customer has reported a missing Product, an investigation will be carried out with the carrier. 


If delivery is not made within a reasonable additional period, the Customer may terminate the contract by exercising their right of withdrawal by sending a message to the customer service at contact@buly1803.com,  as described in Article VI. WITHDRAWAL. The sales contract shall be deemed terminated upon receipt by the Officine Universelle Buly of the Customer’s request informing it of their decision (unless the Officine Universelle Buly has already fulfilled the order in the meantime). In such a case, all sums paid by the Customer shall be refunded to them as soon as possible and no later than 14 (fourteen) days after the date on which the contract was terminated.


It is recalled that, under Article L. 216-3 of the French Consumer Code, any risk of loss or damage to the Products is transferred to the Customer at the moment when the Customer, or a third party designated by them and other than the carrier proposed by the trader, takes physical possession of the Products.


1.6 Click and Collect


The Customer has a period of one (1) month from the notification of the availability of their Order to collect it from the headquarters of the Officine Universelle Buly, located at 27-29 rue Guénégaud, 75006 Paris. 


At the end of this period, and in the absence of any contact from the Customer, the Seller reserves the right to cancel the Order. A refund of the amount paid will then be made via the payment method used at the time of purchase, except for personalised products, for which cancellation or refund will not be possible. 


1.7. Courier


The Customer undertakes to be present and available during the delivery time slot agreed upon when placing the Order. As parcels can only be delivered by courier in person, any absence of the Customer at the time of delivery will result in the parcel being returned to the headquarters of the Officine Universelle Buly, located at 27-29 rue Guénégaud, 75006 Paris.


Any special requests or changes to the delivery arrangements outside the originally agreed framework shall be the sole responsibility of the Customer.


In the event of a failed delivery, the Customer must contact La Voix de l’Officine at the following address: contact@buly1803.com, within fifteen (15) days following the first delivery attempt, in order to agree on the terms of delivery of their parcel. Additional charges may apply depending on the re-delivery terms chosen.


In the absence of contact within the aforementioned period or of any response to the communications from La Voix de l'Officine, the Seller reserves the right to cancel the Order and refund the Items, with the exception of personalised products, for which no refund or exchange will be possible.


2.    Order via Customer Service 


The Customer may also place an order with the Customer Service of the Officine Universelle Buly via the telephone order service. This service allows the Customer to order by telephone, indicating the desired Products, customisations and quantities to the Customer Service.


The telephone order service is available at no additional cost for all orders on +33 1 57 95 03 17 during Customer Service opening hours, or by email at the following address: contact@buly1803.com. 


Products ordered via Customer Service may be delivered across France in accordance with the terms and conditions set out in these General Terms and Conditions. Products ordered via Customer Service may also be delivered across the European Union, as well as to San Marino and Monaco under the conditions set out in Article II of these General Terms and Conditions of Sale. Lastly, Products ordered via Customer Service may be delivered to all other countries worldwide served by our services. 


The Customer may pay for their order by Credit Card (Carte bleue / VISA / MASTER CARD / AMEX / JCB / Maestro/ Diner club or DISCOVER) or Apple Pay, Google Pay and PayPal via a payment link valid for 24 hours sent by email.


This link will allow the Customer to pay for their order on a secure payment platform by entering the number, expiry date, cardholder name and security code of the card used.


The terms and conditions relating to payment by credit card are available on the payment platform. However, the Customer Service of the Officine Universelle Buly remains available to the Customer during opening hours for any questions or additional assistance regarding their order.


The secure payment platform is operated by our partner, Adyen, a secure payment service provider. Accordingly, no banking information of the Customer is transmitted to the Officine Universelle Buly, and the payment is fully secure. Once the payment has been made, the Products are entrusted to the delivery service provider for delivery to the selected address.


It is specified that orders placed via Customer Service are treated as orders placed on the Website and that, consequently, these General Terms and Conditions of Sale also apply to such orders.


V. Statutory Warranty – Commercial Warranty Agreement - Liability - Force majeure


1. Statutory Warranty


The Officine Universelle Buly, as a professional Seller, guarantees that the Products are suitable for their intended use and do not have any defects or hidden faults that would make them dangerous or unfit for their normal use.


In the event that Product(s) do not comply with the information provided when the Product(s) were presented on the Website, and in accordance with Articles L.217-1 et seq. of the French Consumer Code, or if such Products present hidden defects as referred to in Articles 1641 et seq. of the French Civil Code, they will, at the Customer’s choice, be repaired, replaced or refunded. The trader responsible for the statutory guarantees of conformity and against hidden defects is:

In accordance with Article D211-2 of the French Consumer Code:

The consumer has a period of two years from the delivery of the goods to obtain the implementation of the statutory guarantee of conformity in the event of a defect of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it occurred.

Where the contract for the sale of goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the statutory guarantee shall apply to that digital content or digital service throughout the period of supply provided for. During this period, the Consumer is only required to prove the existence of the defect of conformity affecting the digital content or digital service and not the date on which it occurred.

The statutory guarantee of conformity requires the Trader, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The statutory guarantee of conformity gives the Consumer the right to have the goods repaired or replaced within thirty days of their request, at no cost and without significant inconvenience to them.

If the goods are repaired under the statutory guarantee of conformity, the Consumer is granted an extension of six months to the original guarantee.

If the Consumer requests repair of goods, but the Seller insists on replacement, the statutory guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The Consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract and obtain a full refund in exchange for returning the goods, if:

1° The Trader refuses to repair or replace the goods;

2° The repair or replacement of the goods takes place after a period of thirty days;

3° The repair or replacement of the goods causes significant inconvenience to the Consumer, particularly where the Consumer bears the costs of taking back or removing the non-conforming goods, or where they bear the costs of installing the repaired or replaced goods;

4° The lack of conformity of the goods persists despite the Seller’s unsuccessful attempt to bring them into conformity. 

The Consumer is also entitled to a reduction in the price of the goods or to terminate the contract where the lack of conformity is so serious as to justify an immediate price reduction or termination of the contract. In such circumstances, the consumer is not required to repair or replacement of the goods in advance. 

The Consumer is not entitled to terminate the sale where the lack of conformity is minor. 

Any period during which the goods are immobilised for the purposes of their repair or replacement suspends the running of the guarantee that remained outstanding until the delivery of goods once restored to conformity.

The rights referred to above arise from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code (code de la consummation).

A Seller who, in bad faith, obstructs the implementation of the statutory guarantee of conformity of conformity is liable to a civil fine of up to 300 000 euros, which may be increased to up to 10% of average annual turnover (article L. 241-5 du code de la consommation).

The Consumer also benefits from the statutory guarantee against hidden defects under articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a reduction in price of the goods are retained, or to a full refund upon return of the goods.  

To this end, the Customer must return the Product presenting the lack of conformity, in its original condition to the Officine Universelle Buly. In order to secure the return, the Product must be returned in its original packaging, accompanied by the delivery note and bearing the original labels. Before proceeding with the return, the Customer must inform the Officine Universelle Buly of their intention by email at contact@buly1803.com.


Failing this, the Officine Universelle Buly will not proceed with the repair, replacement of refund of the returned defective Product.


Where the return of the defective Product is well founded, the Officine Universelle Buly shall proceed with the repair, replacement or refund of the defective Product and the shipping costs, within a maximum period of thirty (30) days, to the exclusion of any other compensation. Where the Customer’s choice entails a cost that is manifestly disproportionate in comparison with the alternative option, the Officine Universelle Buly shall proceed with that alternative option.


Under no circumstances may repair, replacement or refund be requested and/or carried out in a boutique when the Product has been purchased online.


Except in the cases referred to above, no exchange, refund or repair of the Product is permitted.


The guarantee does not cover damage resulting from modification, repair, integration or addition carried out by the Customer.


The guarantee will not cover items damaged as a result of misuse.


These provisions do not exclude the right of withdrawal set out in Article VI here above.


The statutory guarantee of conformity applies independently of any commercial guarantee that may have been granted. 

2. Responsibility


The Officine Universelle Buly is only under an obligation of best endeavours.


The Customer remains solely responsible for assessing the suitability and appropriateness of the items they order for their needs and consumption.


The Officine Universelle Buly cannot be held liable for any use of the Products that is not in accordance with their intended purpose.


It is hereby reminded that, prior to placing an order, the Customer declares that they have full legal capacity to enter the obligations under these GTS. The Officine Universelle Buly cannot, under any circumstances be required to verify the legal capacity of visitors to the Website or of its Customers. Consequently, if a person without legal capacity were to order items on the Website, their legal representatives would assume full responsibility for that order, including, in particular, payment of the price.


The Officine Universelle Buly does not guarantee that the Website will be continuously available, without temporary interruptions, suspensions, or errors. In particular, the Officine Universelle Buly cannot be held liable for:

  • Any interruptions or delays experienced on the Website due to technical failures, force majeure, the acts of third parties, or any other circumstances whatsoever beyond its control;
  • The Customer’s temporary inability to access the Website due to circumstances beyond their control, such as computer failures, interruptions in the telephone or internet network, or a malfunction of the Customer’s internet reception equipment.  

The Officine Universelle Buly cannot be held liable for (i) the loss, alteration, or unauthorised access to the Customer’s personal data due to the Customer’s own mismanagement, (ii) the processing of personal data carried out by third-party companies mentioned in the GTC, where such companies act as data controllers, or (iii) the accidental transmission of viruses or other harmful elements resulting from internet access or email communications.


Without limiting the scope of the other provisions of the GTC, the liability of the Officine Universelle Buly may only be engaged in the event of a proven fault solely attributable to it. In any case, such liability shall be limited to direct damages only.


The Officine Universelle Buly reserves the right to suspend the operation of the Website.


3. Force majeure


The Officine Universelle Buly cannot be held liable for the improper performance or total or partial non-performance of its obligations where this is due either to the Customer, to an unforeseeable and insurmountable act of a third party to the contract, or to force majeure as defined in Article 1218 of the Civil Code. Such events constitute grounds for the suspension and/or discharge of the Officine Universelle Buly’s obligations towards the Customer, without any compensation being due to the Customer.


VI. Withdrawal


In accordance with the provisions of Article L.221-18 of the French Consumer Code and of European Directive No. 2011/83/EU of 25 October 2011 on consumer rights, the Customer has a period of fourteen (14) calendar days from the date of receipt of the Products ordered on the Website in which to notify the Officine Universelle Buly of their intention to exercise their right of withdrawal and to request a refund for the Product(s) ordered that do not meet their expectations, via the contact section.


The Consumer may notify the Seller of the exercise of their right of withdrawal via email: contact@buly1803.com. 


In order to exercise their right of withdrawal, the Customer must, within fourteen (14) days of delivery, notify the Seller of their intention to withdraw and provide proof of purchase on the Website, together with the Product(s) in complete condition (including, where applicable, their accessories, instructions, guarantee, etc.), perfectly suitable for resale and in their original packaging, to the following address:

The Product(s) must be returned in their original packaging and original unopened wrapping, in a condition allowing resale as new, in accordance with the procedure described on the delivery note enclosed with the dispatch package. The return of the Products must be accompanied by the return form included in the dispatch package, duly completed, or downloadable from the Website.


Any Product that is damaged, used, bears marks, has been modified, or is not returned in its original packaging may under no circumstances be the subject of the right of withdrawal.


Where the Product has been altered as a result of handling other than that necessary to establish the nature and/or conformity of the Product, its characteristics and, where applicable, its proper functioning, the Officine Universelle Buly reserves the right to refuse a refund or exchange of the Product.


The Officine Universelle Buly will not issue a refund if the Products returned by the Customer do not correspond to the Products ordered or if they were not purchased on the Website.

In accordance with Article L.221-28 of the French Consumer Code and Article 16 of European Directive No. 2011/83/EU of 25 October 2011 on consumer rights, the above-mentioned right of withdrawal does not apply to Products:

  • that were originally sealed and have been unsealed and/or used after delivery and are therefore not suitable for return for reasons of health protection and hygiene;
  • made to the Customer’s specifications (engraving for instance) or clearly personalised, including bespoke perfume creations or special orders.

If all of the above conditions are met, the Officine Universelle Buly undertakes to refund the Customer the full amount paid, including the original delivery costs incurred by the Customer, excluding the return costs, which shall be borne solely by the Customer. The refund will be made using the same method of payment as the order, within a maximum of fourteen (14) days after the Customer exercises their right of withdrawal, or at the latest from the most recent of the following dates: either the date on which the Officine Universelle Buly receives the returned Products, or the date on which the Customer provides proof of shipment of the goods for which they have exercised their right of withdrawal, whichever occurs first.


In the event of a partial return of Products, the Officine Universelle Buly will refund only the price of the Products returned, and not any original delivery costs incurred by the Customer, provided that the Customer has received the delivery service for the items retained and that delivery charges do not vary according to the quantity ordered. In the case of the return of Products that were part of a promotional offer including one or more gifts, any gifts provided by the Officine Universelle Buly in connection with the purchase of one or more Products must also be returned to the Officine Universelle Buly.


Return costs are the responsibility of the Customer, except in the case of a lack of conformity of the Products delivered in relation to the order (in which case the return costs will be borne by the Officine Universelle Buly). The Officine Universelle Buly does not accept cash-on-delivery parcels.


All risks associated with the return of the Product(s) are borne by the Customer. The Officine Universelle Buly recommends that its Customers choose a tracked shipping option to avoid any inconvenience in the event of loss or theft of the Products during return transport. 


VII. Confidentiality and Personal Data 


The Officine Universelle Buly implements all reasonable measures to ensure the confidentiality and security of the data collected from the Customer via the Website.


In accordance with the French Data Protection Act and European Regulation 2016/679 of 27 April 2016 (the General Data Protection Regulation, GDPR), the Customer has, at any time, the right to access and rectify their personal data, as well as the right to request its erasure, to object to its processing for legitimate reasons, and to obtain its restriction or portability, to the extent applicable. This right may be exercised by sending a request by email to: privacy@buly1803.com. Proof of identity may be required in certain cases for security and data protection purposes. Minors and Liability of Persons with Parental Responsibility 


By accepting these GTC, you confirm that you are over 16 years of age and that you have not provided false information regarding your age.


Minor users are permitted to browse our website and subscribe to the services offered on the Website, provided that those under the age of 16 have obtained the consent of the person with parental responsibility.


 If you are a person with parental responsibility for a minor under the age of 16 and you allow your child to use our services, you acknowledge that, by authorising your child to use our services, you are bound by the terms of our GTC and our Privacy Policy, and you are responsible for your child’s activities on our website. It is your responsibility to determine which services available on our Website your child is permitted to use and to monitor their use of those services, including any purchases made.

VIII. Intellectual Property


1. Ownership


The trademark “OFFICINE UNIVERSELLE BULY,” all other trademarks and logos associated with the Officine Universelle Buly, whether registered or not, displayed on the Website, as well as the domain name www.buly1803.com, are the exclusive property of the Officine Universelle Buly.


The Website as a whole, together with its constituent elements (including, without limitation, text, soundtracks, software, animations, photographs, videos, illustrations, logos, and, more generally, any distinctive signs), constitutes intellectual works protected under the provisions of the Intellectual Property Code. The Website and its constituent elements are the exclusive property of the Officine Universelle Buly, which alone is entitled to exercise the intellectual property rights and related personal rights therein, including trademarks, designs, copyright, and rights of publicity.


2. Sanctions


The use of all or part of the Website, including by downloading, reproducing, transmitting, displaying, or distributing it for purposes other than the Customer’s personal and private, non-commercial use, is strictly prohibited. Any breach of these provisions renders the offender liable to the sanctions provided under both the Intellectual Property Code and the Civil Code.


3. Hyperlinks


The creation of any hyperlinks to any of the web pages or elements comprising the Website is prohibited, except with the prior written authorisation of the Officine Universelle Buly, such authorisation being revocable at any time. All Websites containing a hyperlink to the Website or any of its elements are not under the control of the Officine Universelle Buly, which therefore disclaims any responsibility, including editorial responsibility, for access to andor the content of such sites.


IX. Entire Agreement 


The Terms and Conditions of Sale, the order summary provided to the Customer, and the order confirmation email together form the contractual framework and constitute the entire contractual relationship between the Parties. They are the only contractual documents binding on the Parties, to the exclusion of any other documents or photographs of the Products, which are provided for indicative purposes only.


X. Non-Waiver


The fact that either Party does not rely on, or does not enforce against the other Party, any breach of any of its obligations under these Terms and Conditions of Sale shall not, for the future, be construed as a waiver of the obligation in question.


XI. Governing Law and Jurisdiction 


These GTC and the contractual relationship between the Officine Universelle Buly and the Customer are governed by French law. Any dispute arising from the application or interpretation of these GTC shall, failing amicable settlement, fall within the jurisdiction of the French courts.


In accordance with Articles L.611-1 et seq. of the French Consumer Code, the Customer is informed of the possibility of having recourse, in the event of a dispute, to a consumer mediation procedure, the terms of which are set out in Title I of Book VI of the French Consumer Code. The consumer mediation service designated by the Officine Universelle Buly is the CMAP online mediation service (Centre de médiation et d’arbitrage de Paris), accessible at www.cmap.fr or by post at: CMAP (Service Médiation de la Consommation - Consumer Mediation Service) – 39 avenue Franklin D. Roosevelt – 75008 Paris, France. For a referral to CMAP to be admissible, it must include the Customer’s postal address, email address and telephone number, together with the full name and address of the Officine Universelle Buly, a brief statement of the facts, and evidence of the steps previously taken. A written complaint must first be submitted to the Customer Service department of the Officine Universelle Buly before any request for mediation is made to CMAP.
